Agreement to terms

These Terms of Service ("Terms") govern your use of growthmotion.org (the "Site") and any services described on it, provided by Growth Motion ("Growth Motion," "we," "us," or "our"). By using the Site or submitting a form on it, you agree to these Terms. If you do not agree, please do not use the Site.

Our services

Growth Motion provides managed Email and LinkedIn outbound campaigns, ICP and prospect research, messaging and offer testing, market intelligence, and outbound strategy for B2B companies, as further described on the Site and in a separate engagement agreement or statement of work with each client.

Growth Motion does not guarantee a specific number of meetings, leads, or amount of revenue. Outbound performance depends on factors outside our control, including your market, offer, product-market fit, targeting, timing, pricing, competition, and messaging. Our commitment is to build and continuously improve an outbound system on your behalf, not to guarantee a specific outcome.

Using the Site

You agree to use the Site only for lawful purposes and to provide accurate information when submitting any form, including the "Build Your Outbound System" form. You agree not to misuse the Site, attempt to gain unauthorized access to it, or interfere with its normal operation.

Engagements and payment

Specific pricing, deliverables, timelines, and payment terms for any engagement are set out separately once we begin working together, and may reference the plan pricing shown on the Site at the time. Plan pricing, features, and the one-time launch fee shown on the Site are subject to change and do not constitute a binding offer until confirmed in a signed agreement or invoice.

Intellectual property

The Site, including its text, design, graphics, and logos, is owned by Growth Motion or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works from the Site without our prior written permission, except as necessary to view it in a standard web browser.

Confidentiality

Information you share with us through the Site or during a strategy call will be used to evaluate a potential engagement and will be treated in accordance with our Privacy Policy. Any additional confidentiality obligations for an active client engagement will be set out in that engagement's agreement.

Third-party links and tools

The Site may link to or use third-party services, such as our scheduling tool, to help you book a call. We are not responsible for the content, policies, or practices of third-party services, and your use of them is governed by their own terms.

Disclaimer

The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Growth Motion will not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Site. Our total liability for any claim relating to the Site will not exceed the amount, if any, you paid to Growth Motion in the twelve months before the claim arose.

Changes to these Terms

We may update these Terms from time to time. We will post the revised version on this page with an updated "Last updated" date. Continued use of the Site after changes take effect means you accept the revised Terms.
